Husband of Emilie Kiser Dodges Charges Over 3-Year-Old Son’s Death
The husband of TikTok Influencer Emilie Kiser will not face any charges in the drowning death of their 3-year-old son, according to the Maricopa County Attorney’s Office. Earlier this month, the Police in Chandler, Arizona, made a recommendation that Brady Kiser, the husband of Emilie Kiser, face a felony charge of child abuse in his son’s drowning death.
Husband of Emilie Kiser Facing No Charges
Although the police recommended the felony charge, the local county attorney’s office has the final say on whether charges are filed. The Maricopa County Attorney’s Office announced, “Maricopa County Attorney Rachel Mitchell announced today that Brady Kiser, husband of Emilie Kiser, will not be charged in the drowning death of his son because there is no reasonable likelihood of conviction.”
Mitchell also added, “Earlier this month, the Chandler Police Department submitted the case for review, recommending that Kiser be charged with one count of Child Abuse, a Class Four Felony. Kiser was home alone with his two children when his 3-year-old son, Trigg Kiser, drowned in the family’s backyard pool in May of this year.”
Mitchell said for the charge to be filed, the state “has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.” According to the announcement, the footage, including surveillance from home, did not meet the criteria for the felony charge.
Trigg’s mother, Emilie Kiser, is an influencer with a huge following on TikTok and Instagram. Brady’s attorney, Flynn P. Carey, said that the married couple is both grieving the loss of their son. “We are grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident.” Carey said, “Brady remains in the midst of the grieving process and is thankful to be with his family as they heal together. We appreciate the compassion and support shown during this difficult time.”
